ZIEGLER CAT 2023 CONEXPO-CON/AGG PROMOTION – Official Rules

Eligibility: Ziegler CAT 2023 CONEXPO-CON/AGG Promotion (“Promotion”) participants must be: (a) a legal resident of the United States or the District of Columbia, (b) at least 18 years of age at the time of entry, (c) in attendance at CONEXPO-CON/AGG ’23 held in Las Vegas, Nevada during the Promotion Period, and (d) a current customer of Ziegler Inc., its affiliates or subsidiaries, as determined by Ziegler Inc. The Promotion, and any website pages and advertisements relating thereto, is intended for viewing only within the jurisdiction of the United States. Promotion is void outside of the United States, or where prohibited or restricted by law.
The Promotion is sponsored by Ziegler Inc. (“Sponsor”). All employees, officers, directors and agents and their immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or any members of their households, regardless of relationship, of Sponsor or its respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and entities assisting with the administration of the Promotion, are not eligible to participate in the Promotion or to win any prizes.
Any Promotion entries received from an ineligible participant will be disqualified. By participating in this Promotion, participants accept and agree to be bound by these rules and the decisions of the Sponsor, which shall be final on all matters. Sponsor reserves the right to modify the rules of the Promotion in any way at any time, subject to state or federal law.
Entrants who violate these Official Rules or engage in any conduct that is illegal, fraudulent, misleading, detrimental or unfair to Sponsor or any other participant, in each case as determined by Sponsor’s sole discretion, are subject to disqualification from entry into the Promotion.
Promotion Period: The Promotion begins on March 15, 2023, at 3:30 p.m. Pacific Time (“PT”), and ends on March 15, 2023, at 6:00 p.m. PT (“Promotion Period”). All entries must be received and recorded by Sponsor during the Promotion Period to be eligible.
Entry: NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. To enter this Promotion, completely fill out registration information on the Promotion webpage via the QR code available at the Ziegler CAT Hospitality Room located at Caesars Palace, 3570 S. Las Vegas Blvd., Las Vegas, Nevada 89109, Palace Tower, Promenade Level – 3rd Floor, Roman Ballroom I-IV. Only one entry per natural person permitted. Duplicate entries will be rejected for entry in the Promotion.
Sponsor is not responsible for lost, misdirected, late, incomplete, illegible or unintelligible entries or for inaccurate entry information, whether caused by the participant or by any of the equipment or programming associated with or utilized in this Promotion, or by any technical or human error that may occur in the transmittal of any entry or the processing of any function on the participant’s computer system including technical problems or traffic congestion on the Internet, or on the website, or any combination thereof. Participant must notify Sponsor of any changed contact information within the Promotion Period to remain eligible to win based on entry information. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Promotion, hacking, cheating, or engaging in other unfair play practices, acting in violation of these rules, or acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar response methods will void all such entries submitted by such methods.
Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend this Promotion for any reason, or should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or impair the administration, security or fairness of the Promotion. Sponsor is not responsible for any human or technological error that may occur in the processing of the Promotion nor are they responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of entries, whether caused by the sender, any of the equipment or programming associated with or utilized in this Promotion, or otherwise.
Prize: Promotion participants will enter for a chance to win one of the following prizes: One potential winner will be selected for the RETEQ RT-700 Wood Pellet Grill for an approximate retail value of $1,199 (USD); two potential winners will be selected with each winner eligible to receive a RETEQ RT-590 Wood Pellet Grill at an approximate retail value of $899 (USD); three potential winners will be selected with each winner eligible to receive a RETEQ RT-B380X Wood Pellet Grill at an approximate retail value of $799 (USD); ten potential winners will be selected with each winner eligible to receive a Benchmade 535BK-4 Bugout Knife at an approximate retail value of $300 (USD); ten potential winners will be selected with each winner eligible to receive an Apple AirPods Pro, 2nd Generation, for an approximate retail value of $250 (USD); ten potential winners will be selected with each winner eligible to receive a Benchmade 15500 Meatcrafter Knife for an approximate retail value of $200 (USD); and ten potential winners will be selected with each winner eligible to receive a Sonos Roam speaker for an approximate retail value of $179 (USD). Total approximate retail value of all prizes: $14,684 (USD).
Prizes are non-negotiable, non-refundable, and not redeemable for cash. No cash redemption or other substitution of any prize is permitted, except by Sponsor, who reserves the right to award a prize of equal or greater value should the prize become unavailable for any reason.
Winner is solely responsible for all applicable federal, state, and local taxes and any expenses associated with the prize. The Internal Revenue Service requires Form 1099-MISC to be issued and filed for each recipient who received a prize/award if the annual aggregate is at least $600 or more. A winner who is a resident of the United States must complete and submit a W-9 form to receive any such prize. The recipient is responsible for any income tax liability and should consult with his/her tax advisor for the proper tax treatment of this income on his/her tax return.
Selection of Winner: Winners will be selected in a random drawing taking place on March 15, 2023, starting at 6:05 p.m. PT, from among all of the eligible entries that have been received by Sponsor during the Promotion Period. The decisions of the Sponsor, including but not limited to, decisions regarding eligibility of entries, selection of winner, and awarding of the prize, are final and binding on all matters relating to this Promotion. If the entrant selected to win a Prize is ineligible or does not agree to the terms and conditions of these Official Rules and to sign the Affidavit of Eligibility and Release, the entrant shall be disqualified and a replacement winner will be selected at random, until the Prize is awarded to a qualified entrant. The odds of winning each Prize will depend upon the number of Prizes to be awarded and the number of valid entries received. Prizes are non-transferrable and non-assignable. Limit one prize per household.
Sponsor will attempt to notify the potential winner via email and phone on or about the date of the drawing. If the potential winner cannot be contacted within three (3) days after the date of the first attempt to contact him/her, Sponsor may select an alternate potential winner in his/her place at random from the remaining eligible entries. Sponsor shall have no liability for the potential winner’s failure to receive notices due to provision of incorrect or otherwise non-functioning contact information or other technical or other issue.
Each winner must satisfactorily complete an affidavit of eligibility showing compliance with these Promotion Official Rules, and each winner must also sign a liability release, allowing Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns to, where permitted by law, without any further notice, review, or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, winner’s entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about Promotion, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. Failure to complete these forms shall result in forfeiture of the Prize. In the event that the potential winner is disqualified for any reason, the Sponsor may select an alternate potential winner by random drawing from among all remaining eligible entries.
Data and Privacy: Ziegler Inc. and its partners, affiliates, subsidiaries, and third parties (each a “Ziegler Party”) collect and share information relating to products, services, and customers as detailed in Ziegler Inc.’s Privacy Policy located at www.zieglercat.com/privacy (“Privacy Policy”). By participating in the Promotion and any promotional or marketing activity sponsored by any Ziegler Party, you consent to the collection, use, storage, processing, sharing, and disclosure of such information, including without limitation, your personal information and entry, by the Ziegler Party in accordance with the terms of these Official Rules and the Privacy Policy.
Limitation of Liability and Dispute Resolution: By participating in the Promotion, each participant and winner agrees to be bound by these Official Rules and agrees: (1) to release and hold harmless Ziegler Inc. and its respective parent companies, subsidiaries, affiliates, officers, directors, owners, employees, members, distributors, retailers, agents, assignees, and advertising and promotion agencies, from any and all liability whatsoever for any claims, losses, harms, damages, injuries, costs or expenses of any kind including, without limitation, property damage, personal injury, or death arising out of or in connection with participation in this Promotion, or acceptance, possession, use or misuse of any Prize, (2) that any and all claims, judgments and awards shall be limited to actual out-of-pocket expenses incurred, but in no event shall include attorneys’ fees and under no circumstances will any participant or winner be permitted to obtain awards for and hereby waives all rights to punitive, incidental, special, consequential damages or any other damages, other than for actual out-of-pocket expenses, and further waives any and all rights to have damages multiplied or otherwise increased, (3) that all issues and questions concerning these rules shall be governed by Minnesota law without giving effect to any principles of conflicts of law of any jurisdiction, and (4) that any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Promotion or any prize awarded shall be (a) resolved individually, without resort to any form of class action; and (b) filed only in the state courts situated in Minnesota, and participant hereby consents and submits to the personal jurisdiction of such courts for purposes of litigating any such disputes, claims or causes of action.

Requests must be received within thirty days of Promotion.
